Rockingham County DB 9:147 1829

Article of Agreement made and entered into between Abraham Head of the County of Rockingham and State of Virginia of the one part and Samuel Coots of the county and state aforesaid of the other part. Witnesseth that the said Abraham Head hath granted bargained and sold unto the said Samuel Coots his the said Head’s Merchant Mill together with the land and appurtenances belonging onto the same being the same that mill and land that said Head purchased of Abraham and Peter Trissell and conveyed to said Head by David Trissell senr being twenty five acres in the whole subject to any exceptions as to water rights and according to said Heads agreement with Trissell and bonds &[?] between Whisler and Lincoln for and in consideration of the sum of two thousand four hundred dollars to be paid in the following manner to wit that is to say two hundred and fifty dollars on the 29th day of June 1829 being the day that said Head is to give possession of the mill to said Coots & one hundred dollars in merchandize out of said Cootes Store one hundred and sixty six dollars and sixty seven cents on the 1st day of April 1830 one hundred and sixty six dollars and sixty seven cents on the first day of April 1831 one hundred and sixty-six dollars and sixty-seven cents on the first day of April 1832 five hundred dollars on the first day of April 1833 two hundred dollars on the first day of April 1834 two hundred dollars on the first day of April 1835 two hundred dollars on the first day of April 1836 two hundred dollars on the first day of April 1837 two hundred & fifty dollars on the first day of April 1838 said Coots is to execute his bonds for the payment above specified and according to their respective amounts and dates it the time said Head makes him a Deed in fee simple for the aforesaid mill land & wich [sic] Deed said Head is to make on or before the first day of October next at wich [sic] time full and peaceable possession of the balance of the premises is to be given to said Coots. Said Head is permitted to keep possession of the dwelling and out houses on the said premises except the mill until the first day of October next and also to enjoy the benefit of the produce that he has put in the ground and to have as much fruit out of the orchard as will be necessary for the use of the family in consideration of wich [sic] he the said Head is to bond the miller that attend the mill for said Coots said Head leaves all the pick, weights, measures and all the apparatus that are now in use and used in the mill at the present time. Said Head is to convey all the rights and privileges that he enjoys under the title made to him by David Trisell Senior in witness whereof we have here unto set our hands and seals this 18th day of June 1829

? the foregoing Agreement by Saml Cootes note on demand for Two hundred and fifty dollars which is for the first payt according said Agreement. June 29, 1829. Abraham Head

? By one hundred dollars in merchandize which is agreeeable to the foregoing agreement the same having been recd by me. August 24th 1829. Abraham Head

August 25th 1829 Then recd in part of the foregoing agreet. three bonds of Saml Cootes that he the said Cootes took up from David Trissel senr being in balance Issued said Trissell on the property I sold Cootes specified in the aforesaid agreement and amounting to the following sums to wit one for one hundred and sixty six dollars and sixty six 1/3[?] cts payable this 1st April 1830 and two ? for the same sum payable the 1st day of April 1831 and 1832 altogether amounting to five hundred dollars which so far is according to the spirit and true intent of the afd agreement. Sept 29th 1829 Then recd of Saml Cootes the following notes to wit one for five hundred dollars payable on the 1st day of April 1833 and four ? for ten hundred dollars each, payable annually from the 1st day of April 1834 until paid also one note for two hundred and fifty dollars for the last installment on the mill and land I sold said Cootes which is to be paid on the 1st day of April 1838 and which when paid will be in full of the contract entered into by the foregoing agreement as witness my hand and seal this day and date above written.
