This Indenture made this 6^th day…………dred & thirty one Between Samuel Cootes and……….of Virginia of the one part, and Abraham Smith of the County and State………that heretofore to wit in the 12^th day of September in the year 1827 the said…………..herein after conveyed house & lot to a certain John Morris then of the County aforesaid………….sold the same to a certain William Morris of the County of Shenandoah & State of Virginia…………sold the same (the said house & lot) to the above named Abraham Smith for the sum of Fourteen……….and one dollar & 25 cents lawful money of Virginia, three hundred and fifty one dollars & twenty five cents thereof the said Abraham Smith has paid to the said William Morris and has executed his single…….to the said William Morris for one hundred and fifty dollars to wit a Single Bill for three hundred………fifty dollars due the first day of August 1831, a single bill for three hundred & fifty dollars due the 1^st…..of August 1832 and a single bill for three hundred & fifty dollars due the 1^st day of August 1833 ……..the balance of the price or purchase of the said house & lot and whereas the said William Morris…….desirous to avoid the trouble and expense of the several intermediate conveyances has requested the abxxx named Samuel Cootes to convey to the above named Abraham Smith the said house and lot……the said John Morris consenting and the said Abraham Smith agreeing and consenting to …this Indenture as a full and lawful compliance with and fulfillment of the said William Mxxxxx engagesent, and agreement with the said Abraham Smith in and about the said house..Lot and the Title thento and to being distinctly understood and agreed between the said William Morris & Abraham Smith that the said sum of one thousand and fifty dollars due for the said house & lot and payable as aforesaid shall be a lien on the said house and lot until the sum is fully paid to the said William Morris his assignees or representatives and its also understood that the said John Morris has paid to me the sum of fifteen hundred and ten dollars being the sum he was to pay to the said Samuel Cootes for the said house and lot (the receipt of which is hereby acknowledged) Now this Indenture witnesseth that for and in consideration of the said sum of fifteen hundred and ten dollars to them the said Samuel Cootes and Emily his wife in hand paid by the said John Morris (The receipt whereof is hereby acknowledged) and for and in consideration of the premises and for purposes hereinbefore set forth in the said Samuel Cootes and Emily his wife have granted bargained & sold and by these presents do grant bargain & sell to the said Abraham Smith and……..heirs & Assignees forever a certain stone house and lot situated on Elizabeth & Irish Street in the Town of Harrisonburg…….County of Rockingham & State of Virginia Bounded on the North by Elizabeth Street on the East……Federal Alley on the South by B.G. Graham & Watson Carr’s lot on the west side by Irish Street being…….same house & lot which was conveyed by the Executors of Thomas Scott decd to James Welch by James Welch to Henry Welch and by Henry Welch to Richard P. Fletcher in Trust and by the……..Richd P. Fletcher as Trustee and by the said Henry Welsh & wife to the Samuel Cootes whxxx several conveyances or deeds are of record in the Clerks Office of the County Court of Rockingxxx to which reference can be had for more special boundaries & c. To have and to hold…….house and lot together with all and singular the appurtenances thereunto belonging……..wise appertaining unto the said Abraham Smith and his heirs and assignees forxxxx……only proper use and behoof of the said Abraham Smith and his heirs and assigns forever………said Samuel Cootes and Emily his wife for themselves and their heirs, executors and………ators doth covenant with the said Abraham Smith his heirs, executors, adminxxxxxx the said house & lot with its appurtenances unto the said Abraham Smith his……..the claim or claims of them the said Samuel Cootes & Emily his wife their……………….of all and every other person or persons whatsoever shall and will warxxxx…………..presents.
