Rockingham County DB 11:175 1832

This Indenture made the 24th day of May in the year 1832 between James Ewing of the County of Marion and State of Missouri of the one part and Saml Cootes of the County of Rockingham & State of Virginia of the other part. Witnesseth that said James Ewing for and in consideration of the sum of Two hundred and twenty five dollars lawful money of Virginia to him in hand paid by the said Saml Cootes the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents do grant bargain and sell to the said Saml Cootes and his heirs and assigns a certain tract or parcel of land lying and being in the County of Rockingham being the same that was sold under a deed of Trust on the 12th day of May 1832 by Saml Cootes as Adm. of Geo. Dove decd being a part of the land conveyed by John Funk to Geo Dove in to secure certain sums of money therein mentioned to Jas Ewing and which on the day of Sale afsd was sold and struck off to the said Ewing he being the highest bidder all of which will fully appear by a reference to a deed made by Saml Cootes to said Ewing bearing date on the 25th day of May 1832 and of Record in the County Court of Rockingham it being known as the Earbaugh lot and bounded as follows. Beginning at the street in Turley Town near Saml Cootes garden N59 1/2W 6 ½ poles to a stake. Thence S34 1/2W9 poles to a stake Saml Cootes line thence N61 1/2W47 poles to a stake. Thence N35E4 poles to a stake thence N57W29 poles 14 links to a large white oak corner to Cootes N40 East 32 poles along Cootes and Horns line to a pile of stones corner to John Rices land and with his line S71 poles to a stake and corner of said Rices lot and with the same S34 1/2E12 poles to a stake. Thence S30 1/2W6 poles to the Beginning. Together with all and singular the appurtenances thereunto belonging or any wise appertaining to have and to hold the said fourteen & half acres of land with its appurtenances unto the said Saml Cootes heirs and assigns forever the only proper use and behoof of him the said Saml Cootes his heirs and assigns forever, and the said James Ewing for himself and his heirs executors and administrators doth covenant with the said Saml Cootes his heirs executors and administrators the said tract of parcel of land containing 14 ½ acres with its appurtenances unto the said Saml Cootes his heirs and assigns against the claim or claims of him the said James Ewing his heirs and all and any person or persons whatever claiming under through or under him shall and will warrant and forever defend by these presents. In witnesseth whereof the said Jas Ewing hath hereunto set his hand and seal in the day and year first written
