This Indenture made this 25th day of May in the Year one thousand eight hundred & thirty two Between Samuel Cootes of the County of Rockingham & State of Virginia of the one part and James Ewing of the County of Marion and State of Missouri of the other part Witnesseth that whereas John Funk of the County & State aforesaid by his certain Indenture Commonly called a Deed in Trust bearing date 5th day of February in the year 1816 and admitted to record in the Clerk’s Office of the County Court of Rockingham did grant bargain sell & convey to George Dove & his heirs & assigns a certain tract or parcel of land in the said Indenture or deed in Trust mentioned and described containing or estimated as containing two hundred eighty acres for the purpose of securing the payment of certain debts in the said Indenture or Deed in Trust mentioned to a certain James Ewing with full power and authority to and in the said George Dove his heirs executors or administrators to sell & dispose and convey to the purchaser of the said tract or parcel of land for the purpose in the said Indenture or deed in Trust mentioned and whereas since the execution of the said Indenture the said George Dove has departed this life without having made or published any last will or testament & the said Samuel Cootes having administered on the Estate of the said George Dove deceased and being as administrator as aforesaid required by the said James Ewing to advertise and sell a part of the said tract or parcel of land for the purposes in the said deed in Trust mentioned and having duly and in compliance with the terms conditions and requitions of the said Indenture or Deed in Trust advertised the time and place of sale. The said Samuel Cootes as administrator as aforesaid did on the 12th day of May in the year 1832 expose to sale at public action to the highest bidder for ready money Turley Town fourteen and half acres being the hereinafter described and conveyed fourteen and half acres of the said tract or parcel of land and the appurtenances to the said fourteen & half acres belonging or appurtaining and the said James Ewing being the highest bidder at one hundred and fifty dollars becomes the purchaser the same being struck off to him. Now this Indenture witnesseth that the said Samuel Cootes as Administrator as aforesaid in further execution of the said Deed in Trust and for and in consideration of the sum of one hundred and fifty dollars to him in hand paid to be applied to the payment of the debts in the said Deed in Trust mentioned. The said Samuel Cootes have granted bargained & sold by the presents doth grant bargain & sell unto the said James Ewing & his heirs & assigns forever a certain lot tract or parcel of land containing fourteen & half acres and bounded as follows to wit Beginning at a stake at the Street near the corner of Samuel Cootes Garden N59 1/2W6 ½ poles to a stake thence South 50 1/2W9 poles to a stake of Samuel Cootes line. Thence N61 1/2W47 poles to a stake thence N35E4 poles to a stake. Thence N57W29 poles 14 links to a large white oak corner to Cootes N40E32 poles along Cootes & Horn line to a pile of stone corner to John Rices land and with his line S71 poles to a stake and corner of said Rice’s lot and with the same S30 1/2E12 poles to another stake S55E6 ½ poles to a stake at the street and with the same S30 1/2W6 poles to the beginning, the same land that was conveyed by John Funk to Jacob Earbaugh Senr by Deed bearing date on the.....day of.....(and being a part of the said tract of land conveyed in Trust as aforesaid). Together with all and singular the appurtenances thereunto belonging or in any wise appertaining to have & hold the said tract or parcel of land with its appurtenances unto the said James Ewing & his heirs & assigns forever to the only proper use and behoof of him the said James Ewing and his heirs & assigns forever, and the said Samuel Cootes as Administrator as aforesaid the said fourteen & half acres of land hereby conveyed with the appurtenances unto the said James Ewing [etc.etc.]
