This Indenture made this 21 day of May in the year one thousand eight
hundred and thirty two between Samuel Cootes of the County of
Rockingham & State of Virginia of the other [sic] part and Samuel Sterling
of the County and State aforesaid of the other part. Witnesseth that
whereas John Funk of the County and State aforesaid by his certain
Indenture commonly called a Deed in Trust bearing date the 5th
day of February in the year 1816 and admitted to record in the Clerks
Office of the County Court of Rockingham did grant bargain sell &
convey to George Dove & his heirs & assigns a certain tract or
parcel of land in the said Indenture a Deed in Trust or parcel in the said
mentioned and described containing or estimated as containing two hundred
and eighty acres for the purpose of securing the payment of certain debts
in the said Indenture or Deed in Trust mentioned to a certain James Ewing
with full power and authority to and in the said George Dove his heirs
executors or administrators to sell and dispose and convey to the purchase
of the said tract or parcel of land for the purposes in the said Indenture
or Deed in Trust mentioned and whereas since the execution of the said
George Dove has departed this life without having made or published any
last will or testament and the said Samuel Cootes having
administered on the Estate of the said George Dove deceased and being
administrator as aforesaid required by the said James Ewing to advertise
and sell a part of the said tract or parcel of land for the purposes in
the said Deed in Trust mentioned and having duly and in compliance with
the terms conditions and requitions of the said Indenture or Deed in Trust
advertise the time and place of sale the said Samuel Cootes as
administrator as aforesaid did on the 12th day of May 1832
expose to sale at public auction to the highest bidder for ready money in
Turley Town a house and lot in Turley Town containing one acre and 14
poles being the hereinafter described and conveyed one acre and 14 poles
of the said tract or parcel of land and the appurtenances to the said one
acre and 14 poles belonging or appertaining and the said Samuel Sterling
through Jas Ewing being the highest bidder at Sixty-Six
Dollars.......cents became the purchaser the same being struck of to him.
Now this Indenture witnesseth that the said Samuel Cootes as
administrator as aforesaid in further execution of the said deed in Trust
and for and in consideration of the sum of Sixty-six dollars to him in
hand paid to be applied to the payment of the debts in the said Deed in
Trust mentioned. The said Samuel Cootes has granted bargained &
sold and by these presents doth grant bargain & sell unto the said
Samuel Sterling & his heirs and assigns forever a certain lot
tract or parcel of land containing one acre and 14 poles and bounded as
follows to wit Beginning at a stake on the east side of Brocks Creek.
ThenceN43W28 poles crossing the road to the edge of said road S31W10 poles
to the corner of Cootes Lot and with the same S56E30 poles to a
stake N39E2 poles to the beginning being a part of the said tract of land
conveyed in Trust as aforesaid together with all and singular the
appurtenances thereunto belonging or in any wise appertaining to have and
to hold the said tract or parcel of land with its appurtenances unto the
said Samuel Sterling and his heirs & assigns forever to the
only proper use and behoof of him the said Samuel Sterling and his
heirs and assigns forever and the said Samuel Cootes as
Administrator as aforesaid the said house & lot hereby conveyed with
the appurtenances unto the said Samuel Sterling and his heirs and
assigns against the claim or claims of him the said Samuel Cootes
his heirs or executors and all other person claiming through or under him
shall & will warrant & forever defend by these presents. In
witness whereof the said Samuel Cootes discharging & fulfilling
the duties devolving on him as administrator of the Estate of the said
George Dove deceased as Trustee as aforesaid hath herewith set his hand
& seal the 21st day and year first above written.
