This Indenture made this 21st day of May in the year of our
Lord one thousand eight hundred & thirty two between Samuel Cootes
of the County of Rockingham & State of Virginia of the one part and
Richard Winfield of the County and State aforesaid of the other
part. Witnesseth that whereas John Funk of the County & State
aforesaid by his certain Indenture Commonly called a Deed in Trust bearing
date the 5th day of February in the year 1816 and admitted to
record in the Clerks Office of the County Court of Rockingham did bargain
sell & convey to George Dove & his heirs & assigns a certain
tract or parcel of land in the said Indenture or deed in Trust mentioned
& described containing or estimated as containing two hundred &
eighty acres for the purpose of securing the payment of certain debts in
the said Indenture or deed in Trust mentioned to a certain James Ewing
with full power and authority to and in the said George Dove his heirs
executors or administrators to sell & dispose and convey to the
purchaser of the said tract or parcel of land for the purpose in the said
Indenture or Deed in Trust mentioned and whereas since the execution of
the said Indenture the said George Dove has departed this life without
having made or published any last will or testament and the said Samuel Cootes
having administration of the Estate of the said George Dove decd and being
as administrator as aforesaid required by the said James Ewing to
advertise & sell a part of the said tract or parcel of land for the
purposes in the said deed in Trust mentioned and having duly and in
compliance with the terms conditions and requitions of the said Indenture
in deed in Trust advertise the time and place of sale the Samuel Cootes
as administrator as aforesaid did on the 12th day of May in the
year 1832 expose to sale at public auction to the highest bidder for ready
money in Turley Town one hundred and forty four & half acres
being the hereinafter described and conveyed one hundred & forty four
and one half acres of the said tract or parcel of land and the
appurtenances to the said one hundred and forty four one half acres
belonging or appertaining and the said Richard Winfield being the
highest bidder at six dollars per acre became the purchaser the same being
struck off to him. Now this Indenture witnesseth that the said Samuel Cootes
as Administrator as aforesaid in further execution of the said deed in
Trust and for and in consideration of the sum of eight hundred & sixty
seven dollars to him in hand paid to be applied to the payment of the
debts in the said deed in Trust mentioned the said Samuel Cootes
have granted bargained & sold and by these presents doth grant bargain
& sell unto the said Richard Winfield his heirs & assigns
forever a certain lot or tract or parcel of land containing one hundred
and forty four and half acres and bounded as follows To wit Beginning at
the second stake from the apple tree N55W220 poles to a stake and pile of
stones. Thence S35W60 poles to two black oaks on a ridge. Thence south 13
E44 poles to two white oaks S39E126 poles a stake and two white oaks
marked the corner of Brittains land N50E37 poles to a stake Brittons
Corner S44E33 ½ poles to a stake and stones Brittons line & corner of
the eight acre tract. Thence S54E18 poles and 12 links to an elm. Thence
S64E20 poles to the middle of the Creek. Thence with the meanders of the
Creek N2 poles N29E15 poles S56E4 poles 12 ½ links N28 E22 poles S88E16
poles N65E32 poles S80E12 poles N44E10 poles to Cootes Corner.
Thence N53W53 poles to a stake near an apple tree. Thence S50W1 pole &
12 links to the beginning. Being a part of the said tract of land conveyed
in Trust as aforesaid together with all and singular the appurtenances
thereunto belonging or in any wise appertaining with all the rights &
privileges appertaining thento to have & to hold the said tract or
parcel of land with its appurtenances unto the said Richard Winfield
and his heirs and assigns forever to the only proper use and behoof of him
the said Richard Winfield and his heirs and assigns forever said
Samuel Cootes as administrator as aforesaid the said one hundred
and forty four and half acres of land hereby conveyed with the
appurtenances unto the said Richard Winfield and his heirs and
assigns against the claim or claims of him the said Samuel Cootes
his heirs or executors and all other persons claiming by through or under
him shall and with warrant & forever defend by these presents. In
witness whereof the said Samuel Cootes discharging and fulfilling
the duties devolving on him as Administrator of the Estate of the said
George Dove deceased as aforesaid hath hereunto set his land & seal
this 25th day and year first above written.
