Turley Town: Cootes to Presbyterian Church

This Indenture made this 23rd day of December in the year of
our Lord one thousand eight hundred & thirty three between Samuel Cootes
& Emily his wife of the County of Rockingham & state of Virginia
of the one part and Andrew Bare and Valentine Switzer, elders of the Presbyterian
Church or congregation near Turley Town in the County aforesaid and
their successors as Elders of the said Congregation of the other part.
Witnesseth that the said Samuel Cootes & Emily his wife who
reside in the Turley Town being anxious and desirous to promote the
Interests of the Redeemers Kingdom the Spread of the Gospel & the
Salvation of Souls by the preaching and teaching thereof as taught by the Presbyterian
Church to which they belong. To that end & for that purpose and for
the purpose of erecting a meeting house or church thereon & for that
purpose only and this Indenture Deed & Conveyance and everything
therein contained to be null and void and of no effect whenever there
ceases to be a Presbyterian Congregation in or nearby Turley
Town and whenever the said Congregation cease to or fail to use the
church meeting house or building that may be erected there or as a place
of Public Worship for Twelve months successively for and in consideration
of the premises aforesaid, and on the conditions and with the reservations
aforesaid. They the said Samuel Cootes & Emily his wife have
granted bargained and sold & by these presents, doth grant bargain
& sell to the said Andrew Bare & Valentine Switzer Elders as
aforesaid & their successors as aforesaid a certain lot of land
situate lying & being in Turley Town, in the County of
Rockingham & state of Virginia and bounded as follows, to wit:
Beginning at a stake on the Great Road, corner of a Garden thence N57 ¼
west 2 poles & 18 links to a stake thence North 32 ¾ East 1 pole
& 18 links to a stake. Thence South 57 ¼ East 2 poles & 18 links
to a stake Thence South 57 ¼ East 2 poles & 18 links to a stake.
Thence South 32 ¾ West 1 pole & 18 links to the beginning. Together
with all & singular the appurtenances thereunto belonging or in any
wise appertaining for the purposes aforesaid. To have and to hold the said
lot with its appurtenances on & with the reservations & conditions
aforesaid & for the purposes aforesaid unto the said Andrew Bare and
Valentine Switzer, Elders as aforesaid and their successors as aforesaid
to the use and behoof of the said Andrew Bare & Valentine Switzer
Elders as aforesaid & their successors as aforesaid for the purposes
aforesaid on the conditions and with the reservations aforesaid forever
and they the said Samuel Cootes & Emily his wife for themselves
their heirs executors & administrators doth covenant to & with the
said Andrew Bare, & Valentine Switzer Elders as aforesaid & their
successors as aforesaid the said lot with its appurtenances for the
purposes aforesaid, and while used as aforesaid, upon the conditions &
reservations aforesaid unto the said Andrew Bare & Valentine Switzer
Elders as aforesaid & their successors as aforesaid, upon the
conditions and with the reservations aforesaid against the claim or claims
of them the said Samuel Cootes & Emily his wife and all other
persons claiming by through or under them or either of them except on the
conditions reservations or limitations herein before expressed & set
forth, shall and will warrant and forever defend by these presents. In
witness whereof, they the said Samuel Cootes & Emily his wife
have hereunto set their hands & seals on the day & year first
above written.
