Rockingham County DB 12:104 1835 (Incomplete Deed)

This Indenture made this 24th day of July 1835 between John Rice and Edith his wife & William Smith of the County of Rockingham and State of Virginia of the one part and Samuel Cootes of the Same County and State of the other part, Witnesseth that whereas the said John Rice by his Deed of Trust duly executed and recorded in the Clerks Office of the County Court of Rockingham conveyed certain real estate and personal property to the said William Smith in Trust for certain purposes in said Trust Deed mentioned which deed bears date on the 23d day of May 1835, and whereas in compliance with the provisions and requirements of said deed of Trust, the said William Smith on the 23d day of May 1835 proceeded to sell to the highest bidder, a certain lot of ground lying and being in Turley Town in Rockingham County and the said Samuel Cootes being highest bidder became the purchaser of said lot for the sum of $20.50 and the said Edith Rice not having united in the deed to said Smith to relinquish her dower to said lot therefore in consideration of the promises and in further consideration of the sum of one dollar in hand paid by the said Samuel Cootes to the said John Rice and Edith his wife and the said William Smith the receipt where of is hereby acknowledged by them the said John Rice and Edith his wife and the said William Smith have granted bargained and sold and by these presents do grant bargain and sell unto the said Samuel Cootes his heirs and assigns forever, a certain lot of ground lying and being in Turley Town, Rockingham County containing about one half acre and bounded as follows to wit beginning at a stake in the main road. Thence with said road S40W5 poles and 21 links to a stake in the road Cootes formerly Billhymers corner thence with his line N53 1/2W8 poles 16 links to a stake near a sugar stump Cootes Corner. Thence N35 1½E3 poles 18 links to a stake Cootes Corner thence N52W2 poles to a stake Emshwiller’s Corner. Thence with his line S75 1/4E6 poles to a stake Emshwiller’s Corner in Whisler’s line thence S25E6 poles and 14 links to the beginning. To have and to hold the said lot together with all and singular the appurtenances. Thereunto belonging or in any wise appertaining to the only proper use and behoof of him the said Samuel Cootes his heirs and assigns forever. And that said John Rice and Edith his wife and William Smith for themselves their heirs, executors or administrators do covenant with the said Samuel Cootes his heirs and assigns that they the said John Rice and Edith his wife the said lot of ground free from the claim of them the said John Rice and Edith Rice his wife and of all and every person or persons whatsoever and he the said William Smith free from the claim or claims of him the said ….
