This Indenture made this 5th day
of October in the year 1842 between Henry May of the County of
Rockingham and State of Virginia of the one part and Samuel Sterling
of the Town of Harrisonburg County & state aforesaid of the other
part. Witnesseth that the said Henry May in order to secure the
payment of seventy three dollars and eleven cents due by single bills on
the 11th May 1842 which the said Henry may stands justly
indebted to Samuel Cootes of the County and state aforesaid and
honestly desired to secure and pay to him and in consideration of the sum
of one Dollar to the said Henry May in hand paid by the said Samuel
Sterling the receipt whereof is hereby acknowledged hasth granted
bargained and sold and by these presents doth grant bargain and sell unto
the said Samuel Sterling the following real and personal estate to
wit: a certain tract or parcel land lying and being in Brocks Gap in the
County aforesaid containing fifty two acres 2 roods and 30 poles and
bounded as follows to wit Beginning at a stake in the bend of State lick
branch thence E38 with said branch to another stake S7 ¾ W115 poles to
two white oak Lambs corner thence S43W36 poles to a black oak saplin
thence N30W11 poles to a white oak and a pine near Bowmans & Clines
corner thence S30W31 poles with said Bowmans line to a pine Bowmans corner
thence N75W54 poles to two white oaks on a ridge thence S81W80 poles to 2
pines thence N30E80 poles to the beginning and also the following personal
property to wit 1 horse, 1 cow, 10 head hogs, 3 sheep, 3 beds, bedsteads
& 1 clock, 5 chairs, 2 ovens, 1 pot, 1 Baker, 1 bureau, 1 table, ½
set of knives and forks, 1 side cupboard and contents, 1 plough. To have
and to hold the said real & personal property herein before mentioned
with all and singular the appurtenances there unto belonging or any wise
appertaining unto the said Samuel Sterling his executors
administrators or assigns forever and the said Henry May doth
hereby warrant and forever defend the said real & personal property
with all and singular the appurtenance unto the said Samuel Sterling
and his heirs and assigns forever upon trust nevertheless that the said
that the sd Samuel Sterling as soon as conveniently he can after
the 5th day of October 1843 if the said Samuel Cootes or
his legal representatives shall order or the said Henry May or his
legal representatives shall request and after given ten days notice of the
time and place of the sale by advertisement at Court House door of the
County of Rockingham shall proceed to sell the said real and personal
property to the highest bidder for the best price that can be obtained in
ready money and out of the money arising from the sale in the first place
to pay all reasonable charges attending the drawing recording and
execution of these presents and costs of sale and the debt aforesaid and
the residue of monies (if any) arising from such a sale as aforesaid to be
paid to the said Henry May his heirs executors, administrators, or
assigns, or to such person or persons as may be duly authorized to receive
the same. In witness whereof the said Henry May & Samuel Sterling
have hereunto set their hand and seal on the day and year first written.
