Harrisonburg: Cootes to Austin 1844

Rockingham Co. DB 17:175 1844

This Indenture made this 11 day of April in the year 1844 between Samuel Cootes of the County of Rockingham and State of Virginia of the one part and Judith Austin of the county and state afsd of the other part. Witnesseth that the said Saml Cootes for and consideration of the sum of four hundred dollars two hundred dollars of which sum was paid on the 1st day of April 1844 and the remaining two hundred dollars to be paid on the 1st day of April 1845 for which last amt the said Judith Austin executor her note payable at the time above specified the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell to the said Judith Austin her heirs and assigns forever a certain lot of ground with its appurtenances in the town of Harrisonburg being the same which was conveyed to the said Samuel Cootes by James Laird and Sarah his wife by deed of Bargain & sale bearing date on the 7 day of June 1843 and of record in the County Court of Rockingham and bounded as follow eth to wit Beginning at a stake on the north east corner of said lot No 8 and running with Martin Steele N80 west 50 feet to a stake corner of the lot formerly owned by Anthony Sourbeer thence with the same S? W97 feet 22 inches to Smith Allen (now Waterman) and then with the said Allen S80 E50 feet to a stake corner to Federal Alley and thence with the said Alley to the beginning together with all and singular the appurtenances thereto belonging or in any wise appertaining to have and to hold the said lot of gound with its appurtenances unto the said Judith Austin and her heirs and assigns forever to the only proper use and behoof of her the said Judith Austin and her heirs and assigns forever and the said Samuel Cootes for himself and his heirs executors and administrators doth covenant with the said Judith Austin her heirs executors and administrators the said lot of ground with its appurtenances unto the said Judith Austin her heirs and assigns against the claim or claims of him the said Samuel Cootes his heirs executors and administrators and all and every person or persons whatever shall and will warrant and forever defend by these present. In witness whereof the said Samuel Cootes hath hereunto set his hand and seal the day and year first above written.
