of Rockingham……..ia of the one part and Samuel Cootes of the
same coun……………the other. Witnesseth thereas by a decree rendered
in the……of Rockingham County chancery……May term 1853………..in
depending between Giles Devier Plaintiff as officer………..the
lands of Levi Shoemaker to sale for the benefit of Judg………and the
said Shoemaker as Defendant it was adjudged…………..decreed that
certain parcels of lands for description of which belonging to said
Shoemaker be exposed to public sale to satisf……….due from said
Shoemaker to said judgment creditors and w……….Devier was
appointed Special Commissioner by the Court to ……..lands &
interests and make such titles for the same as vested said Shoemaker
notice of sale & being required to be given by……..& posting
and the notice having been given of day of sale co………….decree said
Commissioner Giles Devier did on the 17th days of Jun…….to
sale such portion of land mentioned in the Decree as was…………satisfy
the judgement creditors claims all costs appertaining………..to subject
the property to sale and commissioner………Decree into effect at which
sale Samuel Coots being the high……for the tract of land mentioned in
the bill as the one upon w…………Bull was residing and situated near
the mouth of Brocks G…….North Mountain Road supposed to contain 117
acres but of……..missioner asserts nothing bounded as follows.
Beginning at……& black ….corner to Henry Waters, now Michael
Millers la………….W88 poles to a white oak & locust, thence S72W…………..pines,
thence N23W26 poles to a black oak and walnut…….82 poles to two white
oaks, thence N53E………100 poles to two white oaks and a black oak and
thence S70 poles to white pine and black oak, thence S34W83 poles to…….white
oak, thence S61E73 poles to the beginning pay……….the sum of four
hundred and fifteen dollars and being……..bidder for the interest of
said Shoemaker as mentioned in the……..the suit as heir of Elias
Shoemaker in the land lying near Sd residence at the mouth of Brocks Gap
possessed jointly by H……….dec. and the whole tract supposed to
contain 103 acres for be……….reference is made to the deed conveying
the land to……..decd became the purchaser thereof as will as of the for………..Bull
tract paying for this last mentioned the sum of………seventy five
dollars which sales were approved at the June Court subsequent and report
thereinupon confirmed an…………deserving the title of said Shoemaker
to be conveyed to hi…………Devier in conformity with decree of
the Court this the said Giles Devier as Special Commissioner……..aforementioned
sum of……………………………………….as Commissioner as
justified by decree and not making………..liable or responsible
otherwise for title or interest and the same with def……………it
behooves him by virtue of duty as Commissioner appointed for……………mentioned
